Terms and Conditions of Sale
All goods are supplied by The Ironing Equipment Company (TIECO Ltd) (“the Company”) subject to these Terms. These Terms apply to business customers only and exclude any other terms unless agreed in writing.
1. Formation of Contract
Orders are accepted only upon written confirmation. Bespoke or special-order goods cannot be cancelled once procurement or manufacture has commenced.
2. Price and Payment
Prices are exclusive of VAT unless stated otherwise. Payment is due in full prior to dispatch unless agreed in writing.
3. Late Payment
Time for payment is of the essence. Overdue sums bear interest at 8% above the Bank of England base rate pursuant to the Late Payment of Commercial Debts (Interest) Act 1998, calculated daily.
The Company may recover statutory compensation and reasonable debt recovery costs.
4. Warranty Suspension
The Company reserves the right to suspend warranty cover, technical support, or service attendance where any invoice remains unpaid beyond agreed terms.
5. Leasing / Finance
Orders placed using third-party finance are conditional upon written approval. Goods will not be released until finance approval is confirmed.
If finance is declined after procurement has commenced, the Customer remains liable for the full purchase price.
6. Delivery
Delivery dates are estimates only and time is not of the essence. The Company is not liable for delay beyond reasonable control.
The Customer is responsible for ensuring suitable site access and compliance with installation requirements.
7. Risk and Title
Risk passes on delivery. Title shall not pass until the Company has received payment in full for all sums due. The Company reserves the right to recover goods where payment remains outstanding.
8. Installation Requirements
All goods must be installed, connected and commissioned by a suitably qualified and competent engineer in accordance with manufacturer instructions and applicable regulations.
Failure to comply invalidates warranty and may result in additional charges.
9. Water Treatment and Steam Equipment
For steam generators, boilers, presses and equipment connected to a water supply, appropriate water treatment, filtration or softening must be installed where required.
Damage caused by limescale, untreated water, mineral build-up, incorrect pressure or failure to maintain water quality is excluded from warranty.
10. Service Attendance and Call-Out Charges
Where a service visit is requested and no fault is found, or where the fault is due to user error, site conditions, incorrect installation, lack of maintenance, limescale, or non-compliant utilities,
the Customer is liable for all call-out, labour, travel and associated costs at the Company’s prevailing rates.
11. Site Compliance and Engineer Access
If site conditions prevent safe access, installation or repair (including inadequate utilities, unsafe working conditions, restricted access or non-compliant services),
the Company may abort attendance. Abortive visits and return attendances are chargeable.
12. Inspection and Returns
Goods must be inspected upon delivery. Damage or shortages must be reported within 48 hours.
Approved returns may be subject to a restocking charge of up to 25%. Bespoke, special-order or installed goods are non-returnable.
13. Warranty
Goods carry a 12-month manufacturer’s warranty unless otherwise stated. Warranty excludes improper installation, misuse, limescale damage and normal wear and tear.
Liability is limited to repair or replacement at the Company’s discretion.
14. Limitation of Liability
Nothing excludes liability for death or personal injury caused by negligence. The Company is not liable for indirect or consequential loss.
Total liability shall not exceed the price paid for the goods.
15. Personal Guarantee
Where the Customer is a limited company, directors or principals may be required to personally guarantee payment of sums due.
Such guarantee shall be continuing and not discharged by variation or insolvency.
16. Force Majeure
The Company is not liable for delay or failure caused by events beyond its reasonable control.
17. Severability
If any provision is held invalid or unenforceable, the remaining provisions shall remain in force.
18. Governing Law
These Terms are governed by the laws of England and Wales and subject to the exclusive jurisdiction of its courts.
